Although many claims are prepared, presented and defended retrospectively, there is often a contractual obligation to analyse a problem contemporaneously so that a timeous claim or response can be submitted. For instance, the Engineering and Construction Contract requires delaying events and their consequences to be notified and dealt with as they arise.

It is equally important that a client recognises the interfaces between timeous problem analysis and the ability to prosecute or defend adjudication procedures without delay.
